IBJI Data Breach Class Action Settlement

Illinois Bone and Joint Institute, LLC (IBJI) agreed to a $4 million settlement resolving claims that a July 2024 data security incident exposed patients' personal information. U.S. residents who received a Breach Notice from IBJI about the incident can submit a claim for an estimated $50 cash payment, reimbursement of out-of-pocket losses up to $5,000, and two years of Kroll Medical Monitoring. The claim deadline is July 1, 2026.

  • You reside in the United States.
  • You received a Breach Notice from IBJI stating that your Personal Information was potentially compromised in the data security incident IBJI discovered in July 2024, or you received notice from the Settlement Administrator identifying you as a Settlement Class Member. The Settlement Class consists of approximately 568,000 individuals.
  • Excluded: Excluded from the Settlement Class are: the judges presiding over this action and members of their direct families; Illinois Bone and Joint Institute, LLC, its subsidiaries, parent companies, successors, predecessors, and any entity in which IBJI or its parents have a controlling interest; and Settlement Class Members who timely submitted a valid Request for Exclusion.

What happened

On or around July 4, 2024, Illinois Bone and Joint Institute, LLC discovered a data security incident that may have resulted in unauthorized access to the Personal Information of patients and others in its systems. Personal Information includes information that identifies an individual or that in combination with other information can be used to identify, locate, or contact an individual. Plaintiffs filed a class action lawsuit alleging that IBJI failed to implement and maintain adequate data security measures to protect this sensitive information.

IBJI denies all of the plaintiffs' claims and maintains that it did not do anything wrong. The parties agreed to settle to avoid the cost, risk, and time of continued litigation. As part of the settlement, IBJI has also made certain changes to its information security practices.

How to file a claim

  • 1. Confirm you are eligible

    You must be a U.S. resident who received a Breach Notice from IBJI about the July 2024 data incident, or who received notice from the Settlement Administrator identifying you as a Settlement Class Member.

  • 2. Choose your benefit options

    You may claim one or more of the following: (1) an estimated $50 pro rata cash payment (the final amount may be higher or lower depending on total valid claims filed); (2) reimbursement of up to $5,000 for documented out-of-pocket losses related to the data incident incurred on or after May 30, 2024; and (3) two years of Kroll Medical Monitoring, which includes credit monitoring, dark web scanning, and up to $1,000,000 in identity fraud loss reimbursement. You may claim all three benefits.

  • 3. File online or by mail by July 1, 2026

    Submit your Claim Form online at IBJISettlement.com by 11:59 p.m. CT on July 1, 2026, or mail a paper Claim Form (postmarked by July 1, 2026) to: Redman, et al. v. Illinois Bone and Joint Institute LLC, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391.

  • 4. Receive your payment

    Benefits will be distributed after the Court grants final approval at the July 1, 2026 Final Approval Hearing and any appeals are resolved. The appeal process can take a year or more. For Medical Monitoring, you will receive an activation code after Final Approval. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for July 1, 2026 at 10:30 a.m. CT before Judge William B. Sullivan, Courtroom 2410, Richard J. Daley Center, 50 W. Where the money is going

IBJI agreed to establish a non-reversionary settlement fund of $4,000,000 covering all class member benefits, attorneys' fees and costs, service awards to the nine class representatives, and notice and administration expenses.

The estimated $50 pro rata cash payment may increase or decrease depending on the total number of valid claims filed by the approximately 568,000 class members.

Common questions

How much money will I receive?

You can claim up to three benefits: (1) an estimated $50 pro rata cash payment (the final amount may be higher or lower based on total valid claims filed); (2) reimbursement of up to $5,000 for documented, unreimbursed out-of-pocket losses related to the data incident, such as identity theft costs, costs to purchase credit monitoring or freeze credit reports, or other miscellaneous expenses incurred on or after May 30, 2024; and (3) two years of Kroll Medical Monitoring, which provides credit monitoring, dark web and medical identity scanning, SSN monitoring, fraud specialist access, identity theft restoration services, and up to $1,000,000 in identity fraud loss reimbursement (estimated retail value $240/year). You may claim all three.

Do I need to submit proof of purchase?

No documentation is required to claim the estimated $50 pro rata cash payment or two years of Medical Monitoring. If you want to claim reimbursement for out-of-pocket losses (up to $5,000), you will need documentation showing the actual losses were incurred on or after May 30, 2024, and are fairly traceable to the IBJI data incident, such as credit card statements, receipts, or records of costs related to identity theft, fraud, credit monitoring, or credit freezes.

What if I didn’t receive a notice?

You may still be eligible even if you did not receive a Breach Notice, if the Settlement Administrator has identified you as a class member. Contact the Settlement Administrator at (833) 447-8441 or visit IBJISettlement.com to confirm your eligibility and obtain a Claim Form.

Does staying in the class affect my right to sue later?

If you remain in the Settlement Class and do not opt out, you give up the right to sue, continue to sue, or be part of any other lawsuit against IBJI about the legal claims resolved by this settlement. The opt-out deadline of June 1, 2026 has passed. If you did not submit a timely Request for Exclusion, you are bound by the settlement terms.

When will payments be sent out?

The Court will hold a Final Approval Hearing on July 1, 2026. If the settlement is approved and no appeals are filed, benefits will be distributed after that date. Appeals can extend the timeline by a year or more. Medical Monitoring activation codes will be sent to eligible class members after Final Approval. Once you submit your claim, no further action is required.
